General Terms and Conditions (AGB) – Maldire
Article 1 – Definitions
Customer: A consumer or business who places an order through Maldire’s online store.
Day: Calendar day.
Seller: Maldire.
Distance Agreement: An agreement concluded remotely through the seller’s digital commerce system.
Written: Communication by email or other durable medium that allows permanent storage and unaltered reproduction.
Article 2 – Applicability
These general terms and conditions apply to all offers, order confirmations, and distance contracts between the seller and the customer.
Before concluding the contract, these conditions are made available to the customer. If not reasonably possible, the customer will be informed of how to access or receive them free of charge.
By placing an order, the customer agrees to these terms.
Should any clause be found invalid or unenforceable, the remaining provisions remain in effect.
Article 3 – Offer and Agreement
Offers on the website are non-binding. Product images and descriptions are indicative; minor variations may occur.
A contract is only concluded when the seller explicitly confirms the order by email. Automated confirmation does not constitute acceptance of the offer.
The seller reserves the right to reject orders or impose additional conditions, particularly if there are concerns regarding payment reliability or stock availability.
If an ordered product is no longer available, the offer is considered void and any payments will be refunded.
Article 4 – Right of Withdrawal
You have the right to withdraw from the contract within 14 days of receiving the goods, without giving any reason.
To exercise this right, notify us by email at customersupport@maldire.com. The goods must be returned unused, in original condition and packaging, with tags attached.
Returns must be sent using a tracked shipping service and received within 14 days of withdrawal notice.
Exceptions: Products visibly worn, washed, stained, or returned without original tags are not eligible for return or refund.
Article 5 – Refunds
Refunds will be made within 14 days of receiving the cancellation notice, using the original payment method.
The seller may withhold the refund until goods have been received or proof of return is provided.
Shipping costs are non-refundable unless the return is due to an error by the seller.
Article 6 – Prices and Payment
All prices are shown in EUR and include VAT unless otherwise noted. Shipping costs are calculated at checkout.
Payments must be made using the methods offered on the site.
The customer is responsible for the accuracy of billing details. The seller may charge reasonable fees for payment errors or chargebacks caused by the customer.
Article 7 – Delivery
Products are shipped from Germany to the address provided by the customer.
Estimated shipping times are displayed on the website. Delays may occur and do not entitle the customer to terminate the contract unless expressly agreed.
The customer must inspect the goods upon receipt. In case of damage during transport, written notice and photo evidence must be provided within 24 hours of delivery.
Article 8 – Complaints
Complaints related to product quality or fulfillment must be submitted in writing within 7 days of delivery.
Later complaints may not be accepted unless relating to manufacturing defects not visible on delivery.
We aim to respond to all complaints within 14 days. If additional time is needed, you will be notified.
Article 9 – Returns and Uncollected Parcels
Items returned without prior written notice may be rejected.
Customers are responsible for any return shipping costs, unless otherwise stated. For uncollected parcels, the customer will be liable for resulting shipping, storage, and handling costs.
Returned items must be securely packaged and include the completed return form.
Article 10 – Ownership and Intellectual Property
Products remain the property of Maldire until paid in full.
All intellectual property, including garment designs, images, and website content, remains the exclusive property of the seller or its licensors. Any use without written consent is prohibited.
Article 11 – Refusal of Service
We reserve the right to refuse service to anyone, at any time, without obligation to disclose reasons.
Article 12 – Data Protection
Customer data is collected and processed in accordance with the General Data Protection Regulation (GDPR).

Article 13 – Online Dispute Resolution
The European Commission offers a platform for online dispute resolution at:
https://ec.europa.eu/consumers/odr
We are not obligated or willing to participate in dispute resolution before a consumer arbitration board.
Article 14 – Governing Law and Contract Language
All agreements are governed by the laws of the Federal Republic of Germany.
The language of the contract is English. Translations may be provided for convenience only.
